General terms and conditions applicable to M Room barber memberships

1. General These
Terms are part of the M Room membership and the related membership agreement (hereinafter “Membership Agreement”), which is concluded between the person designated as the holder of the membership (hereinafter “Member”) and the local M Room outlet (hereinafter “M Room”) upon activation of the membership.
2. M Room membership
2.1 The membership is valid for the period recorded for each membership product, and the membership and the Membership Agreement arising from the purchase/activation of the membership expire without separate termination at the end date indicated in the Member’s personal membership profile in the My M Room service (my.mroom.com). After this, the Member is entitled to activate a new membership and membership agreement under the terms of the then-current price list.
2.2 The Member is obliged to pay M Room the annual fee in accordance with the then-current price list no later than upon activation of the membership.
2.3 Membership is personal and the Member must prove their identity upon request. However, if necessary, membership may be transferred to another person once during the contract term. The transferable membership must have at least 6 months remaining and a handling fee according to the then-current price list will be charged for the transfer. Special-priced memberships, partner memberships or a membership that has already been frozen once during the contract period cannot be transferred.
2.4 Membership entitles the Member to use services corresponding to the selected membership level (Silver, Gold, Platinum) and to purchase services at member-level prices. The membership levels, price list and product selection with descriptions that are in force at any time are available in M Room outlets. Upon termination of the membership, M Room will not compensate the Member for services or benefits unused during the membership period. M Room has the right to specify the content of member benefits during the term of the agreement.
2.5 Membership entitles the Member to use M Room outlet services at all M Room locations. Service quota benefits are country-specific. Member discounts are valid in all M Room outlets worldwide.
2.6 The membership level (Silver, Gold, Platinum) is defined in the Membership Agreement. The Member may at any time upgrade a full-price annual membership to a higher level. Upon such an upgrade, the Member must pay the additional fee for the upgraded membership level in accordance with the price list in force at the time of the upgrade. Upgrades from special-priced memberships are not generally possible and are handled on a case-by-case basis.
2.7 The Member acknowledges and accepts that Members and other customers are served in outlets in the order set by the My M Room service. The Member also acknowledges and accepts that queue situations vary between outlets, and regardless of membership level one may have to wait for service, and no separate compensation or credit will be paid for this. During the membership, M Room may unilaterally change the product and service selection of its outlets or their opening hours according to demand and resources. M Room reserves the right to mark an outlet as “closed/full” when the queue situation is so congested that additional customers cannot be served within opening hours.
3. Membership information, Member communications and processing of personal data
3.1 For the duration of the membership, the Member will have a personal M Room membership profile in the My M Room service. The membership profile is used to identify the Member and is personal. The My M Room profile login username and password are personal and must not be disclosed or lent to anyone, even temporarily. The Member is obliged to keep the My M Room profile username and password secure and to ensure that no one else can misuse the membership. The Member must immediately notify M Room if login information comes into the possession of an external party or if the membership profile is suspected to be misused. If the Member is unable to use the My M Room service, the Member may prove membership with a photo identity card or equivalent. M Room staff also always have the right to check the Member’s identity when visiting an M Room outlet.
3.2 Upon activation of the membership, the Member agrees that M Room may send information about services and offers to the postal and/or email address provided by the Member. The Member may at any time prohibit the sending of marketing messages.
3.3 The Member agrees that the M Room outlet or companies belonging to the same group may register, store and process personal data relating to the Member (for example contact and payment information) as well as the services the Member has used, in accordance with the Personal Data Act (523/1999, as amended). The purpose of collecting the above-mentioned data is to manage and take care of the membership in the best possible way and to inform the Member about services offered by M Room. The Member consents to M Room storing the Member’s visit and purchase history to ensure the quality of services. The Member always has the right to review their visit history; this can be done via the personal membership profile in the My M Room service.
3.4 The Member’s information will not be disclosed to third parties without the Member’s written consent, except for disclosures required by law.
4. Deferral and termination of membership in special cases
4.1 A Member who for a special reason cannot use their membership for a specified period may apply for a deferral for that period by submitting a free-form written application. The deferral application is submitted to the party that sold the membership. The membership freeze is effective from the day M Room approves the Member’s application. As a result, any binding period of the Membership Agreement is extended by the duration of the approved freeze, and the membership card cannot be used in M Room barber outlets during the agreed freeze period.
4.2 A deferral is granted on the basis of an injury or illness that demonstrably prevents the Member from using M Room services for at least 60 and at most 365 days. A deferral for an extended stay abroad, or for study or work in a locality where M Room does not operate, is granted for a minimum of 90 and a maximum of 365 days. When deferral is applied for repeatedly during one paid membership period, note that the total number of frozen membership days may be a maximum of 365 days and there must be at least 90 days between these freeze periods if the freeze is due to absence from the locality. The membership to be frozen must have at least 30 days remaining in order for a deferral to be granted.
4.3 A deferral application must be made in advance, or in the case of injury or sudden illness at the latest when the Member has a factual opportunity to do so, and it must be confirmed with evidence of an impediment to using M Room services. A deferral request due to absence from the locality as referred to in section 4.2 must always be made before the start of the freeze period. If M Room approves a membership freeze for the reasons set out in section 4.2, the Member must pay a separate handling fee in accordance with M Room’s then-current price list.
4.4 The Member has the right to terminate the Membership Agreement due to an exceptional, unforeseen event affecting them (serious long-term illness or injury that permanently prevents use of M Room services, a move abroad that is more permanent than temporary, or another unforeseen change in life circumstances that makes freezing the Membership Agreement for a set period unreasonable), even if the membership binding period specified in the Membership Agreement has not ended. Termination of the Membership Agreement requires that M Room accepts the grounds for termination. M Room reserves the right to charge the compensation specified in section 4.5 for early termination of the Membership Agreement caused by the Member.
4.5 In the event of early termination of the Membership Agreement
during the membership period for reasons described in section 4.4 or other reasons entitling termination, and where M Room and the Member mutually agree, M Room will repay to the Member the portion of the membership fee that corresponds to the remaining membership period to which the Member was committed in the Membership Agreement. Upon such termination, M Room will deduct from the prepaid annual fee the normal one-off service cost in accordance with the price list for services already used and, in addition, the sale value according to the price list of the product package included in the membership. The remaining amount of the membership fee after these deductions will be paid to the Member as a one-time payment (for example, as a gift card).
5. Amendment of the terms
5.1 M Room has full rights to make changes and develop its operations. The nature of a franchise business concept includes actively developing and improving operations and practices, and therefore M Room reserves the right to make changes that improve the overall functionality of the business concept.
5.2 M Room has the right to suspend a Membership for a period or to terminate the Membership Agreement immediately without compensation if the Member clearly breaches the terms of the Membership Agreement or other instructions issued by M Room.
5.3 M Room membership is always personal and in cases of misuse M Room has the right to cancel the Member’s M Room membership immediately without paying compensation or credit to the Member.
6. Storage of goods and liability for damages
6.1 M Room is not responsible for any personal injuries, thefts or other loss of the Member’s personal property brought into its premises, unless otherwise required by mandatory law. M Room is not responsible for personal property left in an outlet.
6.2 M Room is not liable under any circumstances for temporary prevention of access to services or other temporary restrictions caused by reasons beyond M Room’s control and which M Room could not reasonably foresee or prevent.
6.3 M Room shall have no liability and shall not be responsible for an impediment or restriction to the availability of contractually agreed services that is caused by reasons described below and which prevent performance entirely or significantly impede it. Such restrictions include, among other things, decisions by authorities, new laws or changes to laws, loss of personnel, strike, lockout, blockade, fire, flood, water damage, bankruptcy, loss or destruction of significant assets, epidemic, pandemic, natural disaster, major accident or other similar force majeure. If the use of M Room services is prevented by such an impediment, M Room is not obliged to refund the Member’s paid membership fee or any other unused service or product benefit.
7. Applicable law and dispute resolution
7.1 The Membership Agreement is governed by Finnish law.
7.2 Disputes between the Member and M Room shall be resolved through cooperation. If no mutual agreement is reached, either party may bring the dispute before the district court
